Job summary

As Senior Compliance Counsel for NetApp’s EMEA and APAC regions, you will be an integral part of NetApp’s global Integrity and Compliance Office (“ICO”).  You will manage our current regulatory compliance program as well as further enhance it and create additional policies and processes to ensure an ongoing effective program, compliant with global laws.  You will be responsible for assessing our company operations to determine regulatory compliance risk and advising management on company’s compliance with laws and regulations through regular reports. Through trainings and other communication, you will continue to educate our employees on regulatory compliance and take action in case of non-compliance situations. You will further serve as a liaison between company attorneys, outside counsel and NetApp employees.

Job Requirements

  • Help manage an effective regulatory compliance program.
  • Conduct risk assessments of our business operations in EMEA and APAC regions and create, implement and manage compliance programs and controls in response to those risks.  These will include programs to prevent or mitigate the risk of bribery and corruption, antitrust violations, and policy violations.
  • Conduct and supervise investigations of potential misconduct in EMEA and APAC, ensuring appropriate fact-finding, protection of attorney-client privilege, document retention and recommended findings and action items.
  • Create sound internal controls and monitor adherence to them.
  • Set plans to manage a crisis or compliance violation.
  • Lead a cross-functional team of senior executives who oversee and advise on NetApp’s investigations, compliance controls and compliance programs in the EMEA and APAC regions.
  • Assist with the development and implementation of compliance related policies, including revisions to NetApp’s Code of Conduct, NetApp’s Anti-Bribery and Anti-Corruption Policy, Whistleblower Policy, Gift and Entertainment Policy, Modern Slavery, and other policies.
  • Develop and implement compliance related trainings and communications, to ensure that all our employees are educated on the latest regulations and NetApp policies and processes.
  • Help drive departmental initiatives, including the development of metrics to measure our effectiveness of our compliance programs and the use of technologies to increase efficiencies.
  • Remain up to date on global laws related to the organization and update policies accordingly.

Education

The successful candidate’s profile shall ideally include:

  • Law degree and proven experience (at least 5 years) in assessing, creating, implementing and managing compliance programs for multi-national companies.
  • Strong knowledge of legal requirements and controls.
  • Familiarity with industry practices and professional standards, especially relating to anti-corruption, anti-competition, whistleblower, and similar regulations.
  • Highly analytical with strong attention to detail.
  • A ‘Get things Done’ mindset and ability to find and present sound but also, practical and actionable solutions to adhere to regulations and non-compliant situations.
  • Ability to communicate with intention both speaking and in writing.
  • Ability to thrive in a high performance, fast-paced environment and to multitask, prioritize effectively and meet deadlines.
  • Team-oriented, with a good sense of humor and high level of integrity, responsibility and professionalism, and the ability to build relationships and collaborate across functions.
  • Strong moral code and sense of ethics.
