I would give Lo some benefit of the doubt; he probably did not plan to join Intel when he exited, but rather, Intel convinced him to join after he exited. It is not clear to me that Intel had even tried to poach him while he was still at TSMC.He lied during his exit interview and stole IP. That is betrayal not matter what company you work for or what country you live in.
Had he been honest during the exit interview and said something like "I want to finish my career how it started, with Intel" he would have been fine. Now his reputation, everything he has done, will have a stain on it no matter what the jury says years from now.
As they say, even smart people can be dumb.
