Rumors suggest it is being fabricated by TSMC, as its transistor count falls below the 30-billion-transistor limit imposed by the U.S. government.
This seems plausible to me. Intel 3 doesn't currently have major customers like Xiaomi, Samsung's yield is still low, and if SMIC does have a 3nm process, their top priority would likely be Huawei.

Yes, the presentation slide indicates in Chinese that it is a second-generation 3nm process, which corresponds to N3E—TSMC's second-generation 3nm node following N3B. Intel 3, on the other hand, does not have a second generation.
