Apple wins 539 Million Award, Opens New Frontier for IP

It isn't the importance of this single award, but the precedent it sets going forward for IP in international markets. This is why we need a better international IP protection and registration standard and a stock type market for it. This is key to keep the "Great Acceleration" of knowledge and its applications going at an ever increasing rate. Since the semi/nanotech sector is literally exploding in size and scope, how this develops will be even more important to this industry than most. I see the chance with the new ISO standards to develop whole new ways of developing, registering, marketing and getting paid for IP as creative as the new wave of technical IP itself. Sites like SemiWiki will provide a key forum to discuss creative solutions and options for this in a free flowing open manner. This is an issue that demands the community steps up for the benefit of everyone.

Apple argued for, and received a verdict consistent with, device level royalties, rather than royalties confined to the smallest component unit. I would think Qualcomm's lead attorney, Evan Chesler, was happier than Apple with the verdict.

Reminds me of the old joke -Q. How many square feet are in that building? A. It depends whether you're buying or selling.

ZTE was about Iran sanctions and sending a warning to companies in any country that they would need to follow USA lead on sanctions. It had nothing to do with IP. You would have more of a case if you cite Broadcom vs QC, but in general the trade policy of this administration would throw the tech industry under a bus so long as the bus was made in Detroit and one steel worker got a job. Because, you know who the base is and it is not in the tech industry.

Seriously, the administration is accelerating the reasons for China and even Europe to ramp up self sufficiency in tech. Your IP rights will be the least of the worries.

Let's not forget that this lost Samsung the Apple foundry business which was billions and put Apple and TSMC together. It really was a semiconductor history changing event, absolutely.

Do you really consider that a "rectangle with rounded corners" should be granted as a design patent? Or, how about a "Green Phone Icon"? These are the so-called design patent violations. The Samsung lawyers must have forgot to show the jury photos of the many other mobile devices before iPhone that were shaped as a "rectangle with rounded corners". Comments made by the jurors clearly indicated to me a total lack of understanding about prior art, which invalidate most of Apple's design patent claims.

Both those patents or patent applications are considered a joke in the industry and I don't know if they were even granted, let alone defended successfully. It has been established Samsung set up a parallel engineering team to copy much of the form factor and feel of the iPhone and it is obvious from their product, that they did do this. If anyone has additional insights/facts on this, it would be appreciated. As I have written in these pages numerous times, we need a world wide patent system with a stock market type system for selling rights and their derivatives to keep innovation not only flowing, but accelerating to meet the numerous challenges everyone in the world faces. The current system has to many failings in this increasingly interconnected world. Among other things patents should have different characteristics based on the amount of innovation and creativity involved. There should also be penalties for those that abuse or game the system. Good fences make good neighbors and a good IP system will make a good tech sector and great one will make a great tech sector.

Qualcomm made a smartphone with the same rectangular shape as the iPhone in 1997, and showed it publicly in 1998, a decade before the first iPhone. Enough said. While Apple has lived by the sword, it may take flesh wounds by that sword.

The rectangle shape was a minor issue brought up to divert from the major issues of form and function. Basically the Samsung phone is a copy of the iPhone at the time. Good, clean design, with a clean operating system that Apple had developed for their computers years earlier is what attracted people.
